Terms of Service.

1. Acceptance

By accessing auctionedge.in, app.auctionedge.in, our blog, or any related service (collectively, the "Platform"), you agree to these Terms of Service ("Terms") and our Privacy Policy and Disclaimer.

If you are using the Platform on behalf of an organisation (a prop desk, fund, firm), you represent that you have authority to bind that organisation, and "you" refers to that organisation.

2. Who we are

The Platform is operated by Auction Edge, a passion project run by Surya Ganti, based in Visakhapatnam, India. Auction Edge is not currently incorporated as a legal entity and is not registered with SEBI in any capacity. We will update this section if either changes.

3. The service

The Platform provides:

• Market structure analysis tools for the NIFTY 50 index and related derivatives
• Daily and weekly briefs written by an AI Narrator
• Structural levels, regime analysis, options analytics, and supporting research
• (Future) the AI Trading Coach, a post-trade review tool

These tools are educational and analytical. They are not trade signals, "calls," or recommendations.

4. Accounts

To access the dashboard you must create an account. You agree to:

• Provide accurate information
• Keep your credentials confidential
• Be responsible for all activity under your account
• Notify us immediately of unauthorised use

We may refuse, suspend, or terminate accounts that violate these Terms, abuse the Platform, or pose risk to other users or to us.

5. Acceptable use

You agree not to:

• Use the Platform to publish or distribute material we produce (briefs, analysis, charts, visualisations) without written permission
• Scrape, mirror, or systematically extract data from the dashboard
• Reverse-engineer the engines that power the Platform
• Resell, sublicense, or pass dashboard access to third parties (one human per account, unless you are on a multi-seat plan)
• Use the Platform to harass, defame, or harm any person
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure
• Use the Platform to circumvent any law, including securities and exchange regulations applicable to you

6. Intellectual property

• Our content — all analysis, briefs, code, software, designs, methodology descriptions, and brand elements are owned by us. Educational fair use is fine; redistribution is not.
• Your content — anything you upload (e.g. trades into the AI Coach, messages via the contact form) remains yours. You grant us a limited licence to process it solely to provide the service to you.
• No training rights — we do not use your uploaded trade data to train AI models, ours or anyone else's.

7. Non-advisory clause (important)

Auction Edge is not a SEBI Registered Investment Advisor. We do not provide investment advice, portfolio management, or any service for which SEBI registration is required.

Any analysis, brief, scenario, level, regime label, statistic, or AI-generated commentary on the Platform is for education and information only. It is not a recommendation. It is not personalised. It does not consider your financial situation, objectives, or risk tolerance.

You are solely responsible for any decision to buy, sell, hold, hedge, or abstain from any security, derivative, or other instrument.

8. No warranties

The Platform is provided "as is" and "as available". We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• Data, analysis, or AI-generated output will be accurate, complete, or timely
• The Platform will meet your particular requirements or expectations
• Defects will be corrected within any specific timeframe

Market data is sourced from third parties and may have errors, gaps, or delays. AI output is probabilistic and can be wrong, occasionally confidently. Verify before you act.

9. No liability — use at your own risk

Auction Edge accepts no liability for any loss arising from your use of the Platform. To the maximum extent permitted by law:

• We are not liable for trading losses, opportunity cost, missed gains, account drawdowns, slippage, or any other financial outcome of any decision you make based on anything you see on the Platform
• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages
• We are not liable for data errors, AI hallucinations, missed signals, mislabelled regimes, or any other inaccuracy in our output
• We are not liable for downtime, latency, missed alerts, or Platform unavailability

You use the Platform entirely at your own risk. You trade entirely at your own risk. If you cannot accept this framing, do not use the Platform.

Nothing in this section limits any liability that cannot be excluded under applicable Indian law (e.g. liability for fraud or wilful misconduct).

10. Indemnity

You agree to indemnify Auction Edge against any claim arising from your use of the Platform in breach of these Terms, your violation of any law, or your infringement of any third party's rights.

11. Suspension and termination

We may suspend or terminate your access:

• For breach of these Terms
• For non-payment (paid plans)
• If required by law or regulator
• If continued service poses material risk to the Platform or other users

You may close your account at any time via the dashboard or by writing to us. On closure, we will delete or anonymise your data per the Privacy Policy.

12. Fees and refunds

The Platform is currently free during beta. Paid plans will be introduced; pricing is published at /pricing and you will be notified before any plan you are on becomes paid.

Refunds are governed by the Cancellation & Refund Policy. Refund window: 7 days from first payment on each paid plan.

13. Changes to the service

We will keep building. Features will be added, removed, or rebuilt. We do not guarantee that any specific feature will remain available indefinitely. Material removals affecting paid users will be communicated in advance.

14. Changes to these Terms

We may update these Terms. Material changes will be notified by email and posted with a new effective date. Continued use after the effective date constitutes acceptance.

15. Governing law and disputes

• Governing law: the laws of India.
• Jurisdiction: courts at Visakhapatnam, India, shall have exclusive jurisdiction.
• Arbitration: any dispute that cannot be resolved by good-faith discussion within 30 days shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. Seat: Visakhapatnam. Language: English.

16. Severability

If any provision is held unenforceable, the remainder of the Terms remains in effect.

17. Entire agreement

These Terms, together with the Privacy Policy, Disclaimer, and Refund Policy, constitute the entire agreement between you and Auction Edge regarding the Platform.
